Terms of Service for Tommy House Studios

By using our services, you agree to these terms, in whole, so please take a moment to read through them all. If you have questions, reach out—we're here to help.

General Terms

1. Lawful Use Only:
2. You must use our services legally and responsibly.
3. Don’t upload or share anything harmful, illegal, or offensive (e.g., malware, copyrighted content you don’t own, hate speech).
4. Account Security:
5. Keep your login details secure. Use a strong password that does not include names or that is easy to figure out
6. If you suspect unauthorized access, let us know right away.
7. Service Updates:
8. We may change our terms, pricing, or platforms at any time, with or without notice.
9. Check back occasionally for updates.
10. Termination and Data:
11. You can download an HTML version of your website if you terminate your account, but it won’t include LaunchCMS admin functionality.
12. Violating these terms may result in immediate account suspension or termination without refund.

Payments and Billing

Timely payment of your invoices is essential to maintaining uninterrupted service and avoiding additional fees. Late payments can result in account suspension, reconnection fees, or even permanent data loss after prolonged non-payment. To make things easy, we accept credit card payments directly through your account in our client dashboard, ensuring a quick and secure way to stay current. Keeping your account in good standing helps us continue to deliver reliable services and support.

1. Invoicing:
2. Payments are due at the milestones outlined in your project proposal or the due date on the invoice, with the final payment due at launch. Most all of the billing that we issue invoices on are due on the 1st of the month.
3. Late Payments:
4. Day 1: A 5% late fee applies.
5. Day 3: A $50 reconnection fee is added.
6. Day 5: Your account and data will be deleted if payment isn’t received.
7. Refund Policy:
8. Refunds are not guaranteed and are at our discretion, especially for accounts terminated due to policy violations.
9. Currency:
10. All payments must be made in USD. Returned checks incur a $35 fee.

Website Hosting and Resource Usage

1. Fair Use Policy:
2. Avoid using excessive server resources or uploading large files without permission.
3. We may remove or suspend accounts misusing resources.
4. Content Restrictions:
5. No spam, adult content, pirated software, or anything illegal.
6. Backups:
7. We do keep rolling backups of your website in the cloud within LaunchCMS. You should also keep your own backups of all content (images and text) regarding your website. While we have back up systems for emergencies, we can’t guarantee file recovery.
8. Email Use:
9. No sending spam or using our servers to relay unauthorized emails.

Cancellation and Termination

1. Our Rights:
2. We can suspend or terminate your account for policy violations or other valid reasons such as non-payment.
3. Your Rights:
4. If you cancel, you may request an HTML copy of your website without admin tools.

Support

1. Help When You Need It:
2. Support is available through your client dashboard accessing as tickets and sometimes by phone. While we aim for quick responses, no guaranteed timeframe is provided.
3. Please do not text us for support related cases, use our client dashboard to access your account support.

Entire Agreement

These terms together with any documents expressly referred to in them, contain the entire Agreement between us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to these terms and conditions, you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation, which has not been made expressly in this Agreement.

Tommy House Studios retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification. Violations of these Acceptable Users Policies should be referred to abuse@tommyhouse.com.

Final Notes

ALL CLIENTS, RESELLERS, USERS, AND OR OTHER MEMBERS MUST AGREE TO ABOVE TERMS BEFORE PURCHASING ANY OF THE PACKAGES OFFERED BY TOMMY HOUSE STUDIOS. WE HAVE THE RIGHT TO REVISE ANY OF THE ABOVE TERMS AT ANY TIME.
